In accordance with the Federal Law of December 29, 2012 N 273-FZ "On Education in the Russian Federation", Regulations on the Department of Education of the City of Moscow, approved by Decree of the Moscow Government of September 27, 2011 N 447-PP

I order:

1. Approve the Regulations on the procedure and timing of certification of managers and candidates for positions of heads of state educational organizations subordinate to the Moscow Department of Education (Appendix).

1. General Provisions

1.1. The Regulations on the procedure and timing of certification of managers and candidates for the positions of heads of state educational organizations subordinate to the Department of Education of the city of Moscow (hereinafter referred to as the Regulations), determines the procedure and timing of mandatory certification of managers and candidates for compliance with the position of head of a state educational organization subordinate to the Department of Education of the city Moscow, implementing educational programs of preschool, primary general, basic general, secondary general, secondary vocational education, basic vocational training programs, additional general education programs, additional professional programs (hereinafter referred to as educational organizations).

1.2. The following are subject to certification:

- heads of state educational organizations (hereinafter - heads);

- candidates for positions of heads of state educational organizations (hereinafter referred to as candidates), including deputy heads, as acting powers of the head of an educational organization during his absence.

1.3. Certification of candidates and managers is mandatory.

1.3.1. Certification of managers is carried out in order to confirm the compliance of their level of qualifications with the requirements for the position held.

1.3.2. Certification of candidates is carried out in order to establish compliance of their level of qualifications with the requirements for the position of head of an educational organization.

1.4. The main objectives of certification are:

- determining the level of knowledge of legislation, regulations, regulations, instructions and other documents regulating activities in the field of education;

- stimulation of targeted, continuous improvement of qualifications, personal professional growth, use of effective, modern management technologies, methods and means;

- increasing the efficiency and quality of management activities;

- identifying prospects for using the potential capabilities of managers and candidates.

1.5. The main principles of certification are transparency, openness, and collegiality.

1.6. Certification of managers and candidates is carried out by a certification commission created by the Moscow Department of Education (hereinafter referred to as the Certification Commission).

1.7. Certification of managers and candidates is carried out in two stages: passing qualification tests and an interview with the Certification Commission.

2. Procedure for certification of managers

2.1. The next certification of a manager is carried out no earlier than 5 months and no later than 2 months before the expiration of the previously established certification results.

2.2. Extraordinary certification of the manager is carried out:

- by decision of the Moscow Department of Education (hereinafter referred to as the Department) due to low performance indicators of the educational organization, in the presence of justified complaints, based on the results of inspections, as a result of which violations were identified, etc.;

- by personal decision of the head of the educational organization.

Based on the results of the extraordinary certification, a new validity period for the certification results is established. The validity of previously established certification results is terminated.

2.3. An application from the head of an educational organization for certification (hereinafter referred to as the application) is sent in the form of an electronic document using public information and telecommunication networks, including the Internet, to the organization accompanying the certification procedure in accordance with Section 5 of these Regulations.

Copies of the following documents are attached to the application for certification:

- about education (basic and additional),

- on advanced training (over the last 3 years),

- certification sheet or extract from the order on the results of the previous certification (if available).

2.4. A manager sent for an extraordinary certification submits an application to the Certification Commission no later than 5 working days after the Department makes a decision on the need to undergo an extraordinary certification.

2.5. The organization accompanying the certification procedure, no later than five working days from the date of receipt of the application, conducts a technical examination of the documents attached to the application.

2.6. The duration of the certification procedure is no less than two and no more than four months from the date of receipt of the application until the decision is made by the Certification Commission.

At the written request of the manager being certified, if there are good reasons, the certification procedure may be extended, but not more than for one month.

2.7. The organization accompanying the certification procedure, in relation to managers undergoing certification, no later than three months before the expiration of the previous certification period, sends an information request to the Department (department for working with citizens' appeals, department for the development of public administration and public relations, department of state supervision and control in the field of education), the State Treasury Institution of the City of Moscow, the Financial Control Service (hereinafter referred to as the SFK) on the presence and results of citizens’ appeals, inspections, as well as reports in official media sources, taken into account by the press service of the Department (Appendix).

The results of the information request no later than 5 working days are sent to the organization accompanying the certification procedure for further familiarization with managers and consideration in preparation for certification procedures (testing, generation of certification certificate).

The results of the information request in the form of an electronic document are sent to the certified manager for review no later than 10 working days from the date of submission of the application.

The certified manager does not have the right to make changes or adjustments to the results of the information request.

2.8. The manager, no later than 45 working days from the date of submission of the application, is obliged to sign up and pass qualification tests in the form of testing using an automated system (hereinafter referred to as testing).

During the certification process, the manager has the right to be tested no more than three times within 45 working days from the date of submission of the application.

2.9. Testing is carried out in five modules: “Human Resources Management”, “Resource Management”, “Process Management”, “Results Management”, “Information Management”.

Testing is considered successfully completed if the overall quality of the test is at least 70% and for each of its modules at least 50%.

2.10. If all three testing attempts are passed with a result lower than that specified in clause 2.9 of these Regulations, the first stage of certification is considered completed, the manager is not allowed to take part in the second stage and is recognized as not corresponding to the position held by an order of the Department.

2.11. Features of testing:

2.11.1. The number of modules for testing is determined individually for each head of an educational organization.

2.11.2. Heads of educational organizations that took the first 300 places in the ranking of schools’ contribution to the quality education of Moscow schoolchildren based on the results of the academic year preceding the certification (hereinafter referred to as the heads of schools included in the TOP-300) and who have worked in this educational organization for at least two years are exempt from passing testing, if at the time of submitting the application for certification, all deputy heads are certified for compliance with the position of the head of the educational organization, in the absence of penalties, justified complaints, as well as orders from regulatory authorities and in the presence of positive results of the information request specified in paragraph 2.7 of these Regulations.

2.11.3. Heads of schools included in the TOP-300 are tested based on the results of an information request about the presence and results of citizens’ appeals, inspections, as well as media reports regarding their educational organizations:

- managers who have uncertified deputies on issues of ensuring the quality of education and the implementation of the educational process (on the content of education, on quality control of education, on upbringing, socialization and additional education) are tested in the modules “Process Management”, “Results Management”;

- managers who received instructions from the SFC during the inter-certification period or do not have certified deputies for resource management and financial and economic activities are tested in the “Resource Management” module;

- managers who have had justified negative appeals to the Department from subjects of the educational process are tested in the “Human Resources Management” module;

- managers who, during the inter-certification period, had a violation of the regulations for the provision of information, had no reviews or had negative reviews about the activities of the educational organization in the media at the regional and federal levels (official sources taken into account by the press service of the Department), are tested in the “Information Management” module;

- managers who have disciplinary sanctions are tested in all modules.

2.11.4. Heads of schools not included in the TOP 300 are tested in all modules.

2.11.5. A manager undergoing extraordinary certification by decision of the Department is tested in all modules.

2.11.6. The head of a school included in the TOP-300, undergoing extraordinary certification on his own initiative, is tested in accordance with clause 2.11.2 and clause 2.11.3.

2.12. To conduct certification of a manager, 14 working days before the meeting of the Certification Commission, an attestation certificate is generated in the form of an electronic document, which includes:

- data obtained from the information analytical systems of the Department;

- results of the information request in accordance with clause 2.7 of these Regulations;

- test results;

- proposals from the chairman of the interdistrict board of directors on the period for which the manager can be certified;

- recommendations from those responsible for the implementation of city projects on the certification of heads of educational organizations whose teaching staff made the greatest contribution to the implementation of city projects, for a period of 5 years.

The manager must familiarize himself with the certification certificate against signature no later than 5 working days before the meeting of the Certification Commission. Making changes and adjustments to the certification certificate generated according to the information analytical systems of the Department is not allowed.

2.13. The head is personally present at the meeting of the Certification Commission. If it is impossible to attend a meeting, the manager must notify the executive secretary of this no later than one working day before the appointed date.

Before the interview, the manager orally informs the commission members about the presence or absence of additional information regarding the procedure for conducting his certification.

2.14. The certification commission reviews the certification certificate, conducts an interview with the director, hears from the chairman of the relevant interdistrict board of directors, the adviser to the inspection department of administrative districts of the Department of State Supervision and Control in Education of the Moscow Department of Education and makes one of the following decisions:

- corresponds to the position of the head of the educational organization;

- corresponds to the position of the head of the educational organization, taking into account the recommendations;

- does not correspond to the position held by the head of an educational organization.

2.15. The manager is certified for a period of up to 5 years. If, during the certification of a manager, the Certification Commission makes recommendations, the validity period of the certification results is 3 years.

2.16. In relation to heads of educational organizations holding the honorary title "People's Teacher of the Russian Federation", the decision on suitability for the position held is automatically extended once every 5 years. At the same time, these managers are exempt from passing qualification tests and interviews with the Certification Commission.

In relation to the heads of educational organizations who have recommendations from those responsible for the implementation of city projects, the Attestation Commission makes a decision on suitability for the position held on the basis of an attestation certificate. At the same time, these managers are exempt from passing the first stage - qualification tests.

2.17. Recognize the performance indicators of educational organizations used in the order of the Moscow Department of Education dated October 30, 2014 N 862 “On approval of the Regulations on remuneration of the heads of state educational organizations subordinate to the Moscow Department of Education” as indicators reflecting the results of the management activities of the heads of educational organizations.

The list of heads of educational organizations that have shown high results in management activities is provided to the chairman of the Certification Commission by the Department of Economic Analysis of the Moscow Department of Education based on the results of the annual monitoring of these indicators until March 15 of the current year.

In relation to the heads of educational organizations included in the list of managers who have shown high results in management activities, the Attestation Commission makes a decision on the suitability of the position held on the basis of an attestation certificate. At the same time, these managers are exempt from passing the first stage - qualification tests.

3. Procedure for certification of candidates

3.1. Certification of a candidate is carried out on the basis of an application for certification (hereinafter referred to as the application), which is sent in the form of an electronic document using public information and telecommunication networks, including using the Internet, to the organization accompanying the certification procedure in accordance with section 5 of these Regulations.

The following documents are attached to the application for certification:

- candidate questionnaire;

- a copy of the work book and (or) other document confirming labor activity;

- copies of documents on education (main and additional),

- copies of documents on advanced training for the last three years,

- a copy of the certification sheet or extract from the order based on the results of the previous certification (if available);

Copies of documents are certified by the candidate's employer. If the candidate is temporarily unemployed, copies of documents are certified by the organization accompanying the certification procedure.

3.2. The organization accompanying the certification procedure, no later than 10 working days from the date of receipt of the application, conducts a technical examination of the documents attached to the application.

3.3. Based on the results of a technical examination of documents, the candidate is denied the certification procedure if the following is revealed:

- grounds that prevent you from engaging in teaching activities, and restrictions on engaging in work activities in the field of education,

- termination of the employment contract under Article 81, paragraphs 3, , , , -11 of the Labor Code of the Russian Federation.

3.4. The certification commission admits to certification candidates who do not have special training provided for by the requirements of the EKS and (or) professional standard, but who have sufficient practical experience in the education system of the city of Moscow and professional competence. In this case, candidates must submit a review from the employer containing an assessment of their professional activities, taking into account its effectiveness and significance for the development of the educational organization.

3.5. The candidate must sign up for testing within 45 working days from the date of application.

Upon application, the candidate has the right to two testing attempts.

If within 45 working days from the date of submission of the application the candidate has not signed up for testing, then to resume the certification procedure it is necessary to submit the application again.

3.6. Testing is carried out in five modules: “Human Resources Management”, “Resource Management”, “Process Management”, “Results Management”, “Information Management”.

The test result is considered positive if the overall quality of the test is at least 70% and for each of its modules at least 50%.

If the test results are less than 70% of the overall quality of the test and (or) less than 50% in one of its modules, then the certification procedure for this candidate is terminated, and the Certification Commission does not consider his candidacy at the meeting.

Candidates who have recommendations from those responsible for the implementation of city projects are exempt from passing the first stage of certification - qualification tests in the form of testing.

3.6.1. The test result is valid for one year from the date of passing.

3.6.2. A candidate who has successfully passed the test and is recognized by the Certification Commission as unsuitable for the position of a manager has the right to apply for a second interview with the Certification Commission, but no more than three times during the validity period of the test result.

3.6.3. The clause became invalid on January 1, 2017 - order of the Moscow Department of Education dated December 26, 2016 N 1204..

3.7. To carry out certification of a candidate, an attestation certificate is generated in the form of an electronic document, which includes:

- information obtained from documents provided by the candidate;

- test results;

- recommendations of those responsible for the implementation of city projects (if any).

The candidate must familiarize himself with the certification certificate no later than 3 working days before the meeting of the Attestation Commission.

3.8. The candidate is personally present at the meeting of the Attestation Commission. If a candidate is not present at the meeting, his candidacy will not be considered.

3.9. The certification commission reviews the certification certificate, conducts an interview with the candidate and makes one of the following decisions:

- corresponds to the position of the head of an educational organization for a period of 5 years;

- corresponds to the position of the head of an educational organization for a period of 3 years;
by order of the Moscow Department of Education dated June 15, 2017 N 405.

Corresponds to the position of head of an educational organization for a period of 3 years, taking into account recommendations;

Does not correspond to the position of head of an educational organization.

3.9.1. Candidates for whom more than 80% of the members of the Attestation Commission voted positively are included in the lists of the management reserve of the Moscow Department of Education.

3.10. The candidate's certification results are valid for 3 years.

The validity period of the candidate’s certification results is 5 years when conducting certification of state civil servants:

- performing the functions of deputy heads of the Department;

- performing the functions of heads of departments of the Moscow Department of Education;

- performing the functions of advisers to the inspection department of administrative districts of the Department of State Supervision and Control in the Field of Education of the Department, who were previously certified for compliance with the position of the head of an educational organization subordinate to the Department, and who have fulfilled all the recommendations given to them by decision of the Certification Commission;

- transferred to work in the structure of the Department from the position of head of an educational organization subordinate to the Department.

For current deputy heads of schools included in the TOP-300, certification is allowed for a period of 5 years, if the deputy head has worked in this organization for at least two years, has previously been certified for the position of head of an educational organization subordinate to the Department, and has complied with all the recommendations given him by decision of the Attestation Commission.

4. Operating procedure of the Certification Commission

4.1. The personal composition of the Certification Commissions and their number are approved by order of the Department.

The commission includes representatives of the Department, the chairman or deputy chairman of the Moscow city organization of the trade union of workers of public education and science of the Russian Federation, organizations subordinate to the Department, public figures, representatives of higher education, public organizations, as well as chairmen of interdistrict boards of directors of educational organizations and advisers to the inspection department administrative districts of the Department of State Supervision and Control in Education of the Moscow Department of Education.

4.2. The Certification Commission includes:

- chairman;

- deputy chairmen;

- executive Secretary;

- members of the Attestation Commission.

4.3. Chairman:

- carries out general management of the activities of the Certification Commission;

- presides over meetings of the Certification Commission;

- forms decisions of the Attestation Commission;

- exercises general control over the implementation of decisions made by the Certification Commission.

4.4. The Deputy Chairman, in the absence of the Chairman and (or) on his behalf, presides over meetings of the Attestation Commission and performs the duties of the Chairman.

In the event of the temporary absence of the chairman of the Certification Commission and his deputies, the duties of the chairman of the Certification Commission are performed by the chairman or deputy chairman of the Certification Commission of a different composition approved by order of the Department.

If it is impossible to attend a meeting of the Certification Commission, the chairman, deputy chairman and executive secretary have the right to entrust the execution of their powers to a representative of another member of the Certification Commission on the basis of a power of attorney. If the chairman of the Moscow city organization of trade unions of public education workers of the Russian Federation is absent for a good reason, he can be replaced by a person with an appropriately executed power of attorney from the Moscow city organization of trade unions of public education workers of the Russian Federation.

4.5. Executive Secretary:

- ensures the processing of applications for certification and other documents provided by those being certified;

- provides organizational preparation for meetings of the Certification Commission;

- informs members of the Certification Commission and managers and candidates being certified (hereinafter referred to as those being certified) about the place, date and time of the meeting;

- forms the agenda of meetings, summarizes certification certificates and submits them to the Attestation Commission;

- keeps minutes of meetings of the Certification Commission;

- prepares draft orders based on the results of certification;

- prepares extracts from orders for each certified person for transmission to the employer or certified persons.

4.6. Members of the Attestation Commission personally participate in meetings of the Attestation Commission.

4.7. The chairman of the interdistrict board of directors of educational organizations is invited to a meeting of the Certification Commission and participates in voting only when considering issues of certification of heads of educational organizations located on the territory of the council.

The adviser to the department of inspection of administrative districts of the Department of State Supervision and Control in Education of the Department of Education of the City of Moscow is invited to a meeting of the Certification Commission and participates in voting only when considering issues of certification of heads of educational organizations of the administrative district he supervises.

4.8. A meeting of the Attestation Commission is considered valid if at least half of its total membership is present.

4.9. The decision of the Attestation Commission is made by a simple majority of votes - more than 50 percent of the votes of the entire composition of the Attestation Commission present at the meeting, through secret electronic voting.

During the meeting, the person being certified gets acquainted with the voting results, which are displayed on the electronic scoreboard.

The decision of the Certification Commission is communicated to the certified person immediately after the voting results are displayed on the electronic scoreboard.

When undergoing certification, the certified manager, who is a member of the Certification Commission, does not participate in voting on his candidacy.

4.10. The decision of the Attestation Commission is documented in a protocol, which is signed by the chairman, deputy chairmen, executive secretary and members of the Attestation Commission who took part in the voting.

4.11. The decision of the Certification Commission on the results of certification is approved by order of the Department.

4.12. Extracts from the order based on the certification results are handed over to the certified person against signature.

4.12.1. An extract from the order based on the results of the manager’s certification is kept in his personal file.

4.12.2. When drawing up an employment contract with a certified candidate, an extract from the order is stored in his personal file.

4.13. Disputes regarding violations of the procedure for certification of managers and candidates established by the Regulations are considered in accordance with the legislation of the Russian Federation.

4.14. The person being certified has the right to file an appeal about a violation of the certification procedure established by the Regulations.

Appeals regarding the content and structure of test tasks and interviews with members of the Certification Commission will not be accepted.

4.15. The appeal is submitted in the form of an electronic document within three working days after completion of the certification procedure to the organization accompanying the certification procedure, and is considered by the appeal commission within seven working days from the date of its receipt.

4.16. The composition of the appeal commission is approved by order of the Department.

4.17. The appeal commission organizes a review of the information presented in the appeal and makes one of the decisions:

- on the satisfaction of the appeal;

- dismissal of the appeal.

4.18. The decision of the appeal commission is documented in a protocol. The person being certified is informed of the decision of the appeal commission within two working days at the email address specified by him.

5. Organizational, methodological, information and technical support for certification

5.1. Organizational, methodological, information and technical support for the certification procedure is provided by the State Autonomous Educational Institution of Higher Education in Moscow "Moscow Institute of Open Education" (hereinafter referred to as the Moscow Institute of Open Education).

5.2. Moscow Institute of Open Education:

- accepts and registers applications for certification from managers and candidates in the form of electronic documents using public information and telecommunication networks, including using the Internet;

- organizes the reception of documents and materials necessary for the work of the Certification Commission;

- develops forms of applications for certification, certification certificates, candidate questionnaires and coordinates them with the Certification Commission, and also ensures their placement in the public domain;

- conducts technical examination of documents submitted for certification;

- creates testing schedules and brings them to the attention of those being certified;

- ensures testing;

- organizes information, analytical, organizational and technical support for the work of the Certification Commission;

- develops questions and tasks for testing with the involvement of specialists (if necessary);

- conducts testing of test tasks by members of the Certification Commission;

- develops methodological recommendations for organizing the certification procedure;

- provides psychological support to those being certified;

1. General Provisions

1.1. The Regulations on the procedure for conducting certification of managers and candidates for the positions of heads of state educational organizations subordinate to the Moscow Department of Education (hereinafter referred to as the Regulations) determine the procedure for conducting mandatory certification of managers and candidates for compliance with the position of head of a state educational organization subordinate to the Moscow Department of Education, implementing educational programs of preschool, primary general, basic general, secondary general, secondary vocational education, basic vocational training programs, additional general education programs, additional professional programs (hereinafter referred to as educational organizations).

1.2. The following are subject to certification:

Heads of state educational organizations (hereinafter - heads);

Candidates for positions of heads of state educational organizations (hereinafter referred to as candidates).

1.3. Certification of candidates and managers is mandatory.

1.3.1. Certification of managers is carried out in order to confirm the compliance of their level of qualifications with the requirements for the position held.

1.3.2. Certification of candidates is carried out in order to establish compliance of their level of qualifications with the requirements necessary to perform the job duties of the head of an educational organization.

1.4. The main objectives of certification are:

Determining the level of knowledge of legislation, regulations, regulations, instructions and other documents regulating activities in the field of education;

Stimulating targeted, continuous improvement of qualifications, personal professional growth, the use of effective, modern management technologies, methods and means;

Improving the efficiency and quality of management activities;

Identification of prospects for using the potential capabilities of managers and candidates.

1.5. The main principles of certification are transparency, openness, and collegiality.

1.6. Certification of managers and candidates is carried out by a certification commission created by the Moscow Department of Education (hereinafter referred to as the Certification Commission).

2. Procedure for certification of managers

2.1. The next certification of a manager is carried out once every five years based on an application.

2.2. During the inter-certification period, an extraordinary certification of the manager may be carried out:

By decision of the Moscow Department of Education (hereinafter referred to as the Department), due to low performance indicators of the educational organization, in the presence of justified complaints, based on the results of inspections, as a result of which violations were identified, etc.;

By personal decision of the head of the educational organization.

Based on the results of the extraordinary certification, a new validity period for the certification results is established. The validity of previously established certification results is terminated.

A manager sent for extraordinary certification submits an application to the Certification Commission no later than five working days after receiving notification of certification. In the application for extraordinary certification, the manager indicates the date of passing the qualification tests, which should not exceed 30 calendar days from the date of receipt of the notification of certification.

2.3. An application from the head of an educational organization for certification (hereinafter referred to as the application) is sent in the form of an electronic document using public information and telecommunication networks, including the Internet, to the organization accompanying the certification procedure in accordance with Section 5 of these Regulations.

Copies of documents are attached to the application for certification: on education (basic and additional), on advanced training, an attestation sheet or an extract from the order on the results of the previous certification (if available).

2.4. The organization accompanying the certification procedure, no later than five working days from the date of receipt of the application, conducts a technical examination of the documents attached to the application.

2.5. The duration of the certification procedure must be no less than one and no more than four months from the date of receipt of the application until the decision is made by the Certification Commission.

At the written request of the manager being certified, if there are good reasons, the certification procedure may be extended, but not more than for one month.

2.6. The manager, no later than 30 calendar days from the date of submission of the application, is obliged to sign up and pass qualification tests in the form of testing using an automated system (hereinafter referred to as testing).

Testing is carried out in five modules:

Invariant part: “State policy in the field of education”, “Legal basis of management”,

Variable part: “Financial and economic foundations of management”, “Business administration”, “Educational technologies”, “Functional responsibilities in the administrative team 00”, “Ensuring the safety of the educational process”, “Organization of the educational process”, “Use of information systems in the management of educational organization”, “Organization of financial and economic activities of an educational organization”.

The number of variable modules is not constant.

The choice of the variable part of testing is carried out when submitting an application for certification.

2.7. Testing is considered successfully completed if the overall quality of the test is at least 70% and for each of its modules at least 50%.

During the certification process, the manager has the right to be tested no more than two times. The manager uses both testing attempts within 30 calendar days from the date of submission of the application.

2.8. If the test results are less than 70% of the overall quality of the test and (or) less than 50% in one of its modules, then the certification procedure for this manager is terminated, and the certification commission does not consider his candidacy at the meeting.

2.9. Features of testing:

2.9.1. Heads of educational organizations that took the first 300 places in the ranking of state educational organizations that showed high educational results based on the results of the academic year preceding certification:

They are exempt from testing if the educational organization is ranked from 1st to 20th place;

They are tested in the module “State policy in the field of education” if the educational organization is in the ranking from 21 to 70 places;

They are tested in the modules “State policy in the field of education” and “Legal foundations of management”, if the educational organization is in the ranking from 71 to 170 places;

They are tested in the modules “State policy in the field of education”, “Legal foundations of management” and in one of the variable modules, if the educational organization is in the ranking from 171 to 300 places.

2.9.2. A manager undergoing extraordinary certification by decision of the Department is tested in all modules in accordance with clause 2.6. of this Regulation.

2.9.3. A manager undergoing extraordinary certification on his own initiative is tested in accordance with clause 2.9.1.

2.10. To conduct certification of a manager, an attestation certificate is generated in the form of an electronic document, which includes:

Information obtained from information and analytical systems of the Moscow Department of Education; test results;

Information provided by the manager; proposals from the Department and the chairman of the interdistrict board of directors on the period for which the manager can be certified.

The manager must familiarize himself with the certification certificate no later than five working days before the meeting of the Certification Commission.

2.11. The head is personally present at the meeting of the Certification Commission. If it is impossible to attend a meeting, the manager must notify the executive secretary of this no later than two working days before the appointed date.

Before the interview, the manager is obliged to orally inform the members of the commission about the presence or absence of additional information regarding the procedure for conducting his certification.

2.12. The certification commission reviews the certification certificate, conducts an interview with the director, hears from the chairman of the relevant interdistrict board of directors, the adviser to the inspection department of administrative districts of the Department of State Supervision and Control in Education of the Moscow Department of Education and makes one of the following decisions:

Corresponds to the position of the head of the educational organization;

Corresponds to the position of the head of the educational organization, taking into account the recommendations;

Does not correspond to the position of head of an educational organization.

2.13. The manager is certified for a period of up to 5 years. If, during the certification of a manager, the Certification Commission makes recommendations, the validity period of the certification results is two years.

3. Procedure for certification of candidates

3.1. Certification of a candidate is carried out on the basis of an application for certification (hereinafter referred to as the application), which is sent in the form of an electronic document using public information and telecommunication networks, including using the Internet, to the organization accompanying the certification procedure in accordance with section 5 of these Regulations.

The following documents are attached to the application for certification:

Candidate Profile;

A copy of the work book and (or) other document confirming labor activity;

Copies of documents on education and advanced training; a copy of the certification sheet or extract from the order based on the results of the previous certification (if available).

3.2. The organization accompanying the certification procedure, no later than ten working days from the date of receipt of the application, conducts a technical examination of the documents attached to the application.

3.3. A candidate may be denied the certification procedure if:

Grounds preventing the engagement in teaching activities and restrictions on employment in the field of education,

Termination of an employment contract under Article 81, paragraphs 3,5,8,9-11; under Article 278 clause 2 of the Labor Code of the Russian Federation - within two years from the date of termination.

Lack of special training required by the EKS requirements and lack of work experience in teaching positions.

3.4. The certification commission has the right to admit to certification candidates who do not have special training provided for by the requirements of the EKS and (or) professional standard, but who have sufficient practical experience in teaching activities in the education system of the city of Moscow and professional competence. In this case, candidates must submit a review from the employer containing an assessment of their professional activities, taking into account its effectiveness and significance for the development of the educational organization.

3.5. The candidate, within 30 days from the date of submission of the application, is required to register in the electronic system accompanying the certification procedure for managers and sign up for testing.

Testing is carried out in accordance with clause 2.6 of these Regulations.

During certification, the candidate has the right to be tested no more than twice during one academic year.

The test result is considered positive if the overall quality of the test is at least 70% and for each of its modules at least 50%.

If the test results are less than 70% of the overall quality of the test and (or) less than 50% in one of its modules, then the certification procedure for this candidate is terminated, and the Certification Commission does not consider his candidacy at the meeting.

3.6. To carry out certification of a candidate, an attestation certificate is generated in the form of an electronic document, which includes:

Information obtained from documents provided by the candidate;

Test results.

The form of the certification certificate is established by the organization accompanying the certification procedure, in agreement with the Department.

The candidate must familiarize himself with the certification certificate no later than three working days before the meeting of the Attestation Commission.

3.6. The candidate is personally present at the meeting of the Attestation Commission. If a candidate is not present at the meeting, his candidacy will not be considered.

3.7. The certification commission reviews the certification certificate, conducts an interview with the candidate and makes one of the following decisions:

Corresponds to the position of the head of an educational organization;

Corresponds to the position of the head of an educational organization, taking into account the recommendations;

does not correspond to the position of the head of an educational organization.

3.8. The candidate's certification results are valid for two years.

In the case of certification of civil servants transferred to work in the structure of the Department of Education of the city of Moscow from the position of head of an educational organization, certification is allowed for a period of 5 years.

3.9. Uncertified candidates have the right to re-submit documents for certification no earlier than one year after the decision of the Certification Commission.

4. Operating procedure of the Certification Commission

4.1. The personal composition of the Certification Commissions and their number are approved by order of the Moscow Department of Education.

The commission includes representatives of the Moscow Department of Education, the chairman or deputy chairman of the Moscow city organization of the trade union of workers of public education and science of the Russian Federation, organizations subordinate to the Moscow Department of Education, representatives of higher professional education, public figures, as well as chairmen of interdistrict boards of directors of educational organizations .

4.2. The Certification Commission includes: Chairman; deputy chairmen; executive Secretary; members of the Attestation Commission.

4.3. Chairman:

Provides general management of the activities of the Certification Commission;

Chairs meetings of the Certification Commission; forms decisions of the Attestation Commission; exercises general control over the implementation of decisions made by the Certification Commission.

4.4. The Deputy Chairman, in the absence of the Chairman and on his instructions, presides over meetings of the Certification Commission and acts as Chairman.

4.5. Executive Secretary:

Ensures the processing of certification applications and other documents provided by those being certified;

Provides organizational preparation for meetings of the Attestation Commission;

Informs members of the Certification Commission and managers and candidates being certified (hereinafter referred to as those being certified) about the place, date and time of the meeting;

Forms the agenda of meetings, summarizes certification certificates and submits them to the Attestation Commission;

Keeps minutes of meetings of the Certification Commission; prepares draft orders based on certification results;

Prepares extracts from orders for each certified person for transmission to the employer or certified persons.

4.6. Members of the Attestation Commission personally participate in meetings of the Attestation Commission.

4.7. The chairman of the interdistrict board of directors of educational organizations is invited to a meeting of the Certification Commission and participates in voting only when considering issues of certification of heads of educational organizations located on the territory of the council.

4.8. Meetings of the Certification Commission are held at least once every two months.

4.9. A meeting of the Attestation Commission is considered valid if at least 2/3 (two thirds) of its members are present.

4.10. The decision of the Attestation Commission is made by a simple majority of votes of the entire composition of the Attestation Commission present at the meeting.

When undergoing certification, the certified manager, who is a member of the Certification Commission, does not participate in voting on his candidacy.

4.11. The decision of the Attestation Commission is documented in a protocol, which is signed by the chairman, deputy chairmen, executive secretary and members of the Attestation Commission who took part in the voting.

4.12. The decision of the Certification Commission on the certification results is approved by order of the Moscow Department of Education.

4.13. An extract from the order based on the results of the manager’s certification is kept in the manager’s personal file.

An extract from the order based on the candidate’s certification results is handed over to the candidate himself against signature. When drawing up an employment contract with a certified candidate, an extract from the order is stored in his personal file.

4.14. Disputes regarding certification of managers and candidates are considered in the manner established by the legislation of the Russian Federation

5. Organizational, methodological, information and technical support for certification

5.1. Organizational, methodological, information and technical support for the certification procedure is provided by the State Autonomous Educational Institution of Higher Professional Education in Moscow "Moscow Institute of Open Education" (hereinafter referred to as the Moscow Institute of Open Education).

5.2. Moscow Institute of Open Education:

Receives and registers applications for certification from managers and candidates in the form of electronic documents using public information and telecommunication networks, including using the Internet;

Organizes the reception of documents and materials necessary for the work of the Certification Commission;

Develops application forms for certification, certification certificates, candidate questionnaires and coordinates them with the Certification Commission;

Conducts technical examination of documents submitted for certification;

Forms testing schedules and brings them to the attention of those being certified through the website of the Moscow Institute of Open Education;

Provides testing;

Organizes information, analytical, organizational and technical support for the work of the Certification Commission;

Develops questions and tasks for testing with the involvement of specialists (if necessary);

Provides psychological support to those being certified (if necessary);

Ensures the development and operation of an electronic resource for supporting the certification of candidates and managers;

Maintains a database and archive of managers and candidates who have passed the certification procedure;

Presents reporting documentation based on the results of the certification.

Candidates for the position of head of a state or municipal educational organization and its head (with the exception of heads of federal universities and heads of educational organizations, in cases established by federal laws) undergo mandatory certification.

This means that the certification of candidates for the position of head of an educational organization is a legislative necessity, the procedure and timing of which are established by the founder of this educational organization.

But as for current managers, the Law, unlike the certification of teaching staff, does not contain any instructions on the frequency of their certification, but only records the very fact of certification, the procedure and timing of which are established by the founders of these educational organizations.

In accordance with the law, the founder has the right to establish not only any procedure for conducting certification of the manager, but also any frequency.

In particular, the founder has the right to completely exclude the periodic conduct of regular certification, while maintaining the obligation to conduct an extraordinary one.

The reasons for its implementation may be:

— repeated violations by the head of the current legislation, confirmed by documents;

— repeated violations by the manager of his job description, documented;

In practice, as an analysis of regulations at the regional and municipal levels shows, in the vast majority of cases, the founders set for managers the frequency of undergoing regular certification for compliance with the position held once every five years (there are also those who reduce this period to three years). Let's try to find out how advisable it is to conduct periodic (regular) certification of current managers.

Currently, there is a tendency to conclude fixed-term employment contracts with managers for a period of up to five years. The basis for this is Part 2 of Art. 59 of the Labor Code of the Russian Federation.

At the same time, the very fact of renewing the contract with the manager for the next term means that the activities of such a manager are completely satisfactory to the founder. In other words, the manager with whom the contract was renewed corresponds to the position held from the founder’s point of view.

But then why do we need periodic certification of managers? After all, if the founder has reasonable doubts about the manager’s suitability for the position held, then he initiates an extraordinary certification in the manner and within the time frame established by him.

With this approach to organizing the certification procedure, the founder will have to organize and conduct certification of only candidates for the position of manager and unscheduled certification of current managers (p An example of the Regulations on the certification of candidates for positions and heads of educational organizations is given in Appendix 1 to the article).

As for the use of the motivational potential of the certification procedure in order to stimulate the professional growth of managers, it can be implemented in the form of voluntary certification for compliance with regional (municipal) qualification levels.

Such levels can be formulated based on performance criteria in the context of the transition to an efficient contract, but that, as they say, is another story.

Appendix 1. Regulations on the certification of candidates for positions and heads of educational organizations

1. General Provisions

1.1. This Regulation has been developed in accordance with Part 4 of Art. 51 of the Federal Law “On Education in the Russian Federation”.

1.2. These Regulations determine the procedure and timing of certification of candidates for positions and heads of educational organizations.

For the purposes of applying these Regulations, the positions of heads of educational organizations include positions classified as “Managers” of the Nomenclature of positions of teaching staff of organizations engaged in educational activities, positions of heads of educational organizations (Resolution of the Government of the Russian Federation of August 8, 2013 No. 678).

1.3. Certification is carried out on the basis of an objective assessment of the professional activities of managers and applicants for the position in order to determine their suitability for the position of “Head of an educational organization.”

1.4. The main principles of certification are: collegiality, transparency, openness, objectivity, and non-discrimination.

1.5. Candidates for the position of head of an educational organization are subject to mandatory certification before appointment to the position.

1.6. Heads of educational organizations undergo mandatory (extraordinary) certification when:

— repeated violations of current legislation by them, confirmed by documents;

— repeated violations of their job descriptions, confirmed by documents;

- negative dynamics of the results of students mastering the implemented educational programs in comparison with previous periods, confirmed by documents;

— justified, confirmed complaints from students (their legal representatives) about the low performance indicators of the educational organization.

2. Certification commission

2.1. Certification of candidates for positions and heads of educational organizations is carried out by an attestation commission consisting of: chairman, deputy chairman, secretary and members of the commission formed by a local government body (authorized government body of a constituent entity of the Russian Federation).

2.2. The chairman of the certification commission is the head (person authorized by him) of the municipal (regional) body exercising management in the field of education.

2.3. The certification commission includes employees of the municipal (regional) body exercising management in the field of education, a representative of the municipal (regional) organization of the trade union of workers of public education and science of the Russian Federation, heads of educational organizations, as well as representatives of scientific, educational and other organizations invited by the chairman of the certification commission as independent experts. The composition of the commission is annually approved by an administrative act of a local government body (an authorized body of state power of a constituent entity of the Russian Federation) upon the proposal of the chairman of the commission. All members of the commission have equal rights when making decisions.

2.4. The composition of the certification commission is formed in such a way as to exclude the possibility of a conflict of interest that could affect the decisions it makes.

2.5. If there is a direct or indirect personal interest of any member of the certification commission, which may lead to a conflict of interest when certifying a particular person being certified, he is obliged to declare this before the start of the meeting. In this case, he does not take part in making a decision regarding a specific person being certified.

2.6. The chairman of the certification commission manages its activities. During his temporary absence, his deputy manages the activities of the commission.

2.7. To ensure the work of the certification commission, its secretary is appointed.

2.8. The schedule of meetings of the certification commission for each quarter is approved by the chairman of the certification commission.

2.9. A meeting of the certification commission is considered valid if at least two-thirds of its roster is present.

2.10. The decision of the certification commission is made by a simple majority of votes. In case of equality of votes, the decision is made in favor of the person being certified. The decision comes into force from the day it is made.

2.11. The duration of certification of a specific certified person cannot exceed 30 calendar days.

2.12. If the person being certified is found to be ineligible for the position of “Head of an educational organization,” the employment contract with him may be terminated in accordance with clause 13 of part 1 of Article 81 of the Labor Code of the Russian Federation on the grounds provided for in the employment contract.

Termination of an employment contract with the head of an organization on this basis is possible if such a basis for terminating the employment contract is provided for in it; if not, then the employment contract should be terminated in accordance with Part 2 of Article 278 of the Labor Code of the Russian Federation.

3. Certification of candidates for the position of head of an educational organization

3.1. The basis for conducting certification of candidates in order to determine their suitability for the position of “Head of an educational organization” may be:

— representation of the head of the municipal (regional) body exercising management in the field of education;

— representation of the collegial governing body of the educational organization;

- statement of the candidate.

3.2. The submission to the certification commission must contain the following information about the candidate:

- Full Name;

— information on advanced training (retraining) (with copies of relevant documents attached);

— motivated, comprehensive and objective assessment of professional, business qualities, results of professional activities based on the professional standard (qualification characteristics) “Head of an educational organization.”

3.3. The candidate's application must contain the following information about him:

- Full Name;

— place of work and position held;

— presence of a qualification category for the position held;

— date of conclusion of the employment contract for the position held;

— level of education and qualifications (with copies of relevant documents attached);

— information on advanced training (retraining) (with copies of relevant documents attached).

To the application, the candidate attaches either a program for overcoming a crisis situation in a specific educational organization, or a program for the development of an educational organization, taking into account the characteristics of its educational activities (gymnasium, school with in-depth study of a specific subject, a school implementing a specific additional pre-professional program, a school implementing inclusive education and etc.).

3.4. During the certification process, the candidate must undergo qualification tests on knowledge of the current legislation on education.

3.5. The candidate for the position of manager must be familiarized with the date, time and place of the certification by the secretary of the certification commission against signature no later than a month before the date of its holding.

3.6. A candidate for the position of manager must be personally present at the meeting of the certification commission during his certification.

If it is impossible to attend a meeting of the certification commission for valid reasons (illness, business trip, etc.), the necessary changes are made to the certification schedule.

3.7. Directly during the certification process, the commission reviews information about the candidate for the position of head contained in the submission (his application), and also assesses the candidate’s suitability for the position of “Head of an educational organization.”

Members of the certification commission, if necessary, have the right to ask the certified person questions related to the performance of the duties of the head of the educational organization.

The secretary of the certification commission keeps minutes of its meeting, which records its decisions and voting results. The minutes are signed by the chairman, deputy chairman, secretary and members of the commission present at the meeting, and are stored as part of a separate file in the municipal (regional) body that manages the field of education.

3.8. Based on the results of the candidate’s certification, the certification commission makes one of the following decisions:

3.9. If a candidate fails to appear at a meeting of the certification commission without a good reason or if he is recognized as not suitable for the position of “Head of an educational organization,” he can re-pass certification for compliance with the position of “Head of an educational organization” no earlier than one year after the date of the meeting of the certification commission.

3.10. The certified person becomes familiar with the certification results, documented in the protocol, against signature.

3.11. For everyone who has passed certification, an extract from the protocol is drawn up containing the following information: last name, first name, patronymic of the person being certified, his place of work and position, the date of the meeting of the certification commission, the results of voting when making a decision, which is signed by the secretary of the certification commission. An extract from the protocol and the presentation (application) are stored in the personal file of the person being certified.

3.12. A candidate recognized as appropriate for the position of “Head of an educational organization” based on the results of certification may be:

- appointed to the position of manager;

— included in the reserve of managers.

4. Certification of the head of an educational organization

4.1. The decision to conduct certification of the head of an educational organization is made by the founder if the following grounds exist:

— repeated violations by the head of the current legislation, confirmed by documents;

— negative dynamics of the results of students mastering implemented educational programs in comparison with previous periods in the same educational organization, documented;

- justified, confirmed complaints from students (their legal representatives) about the low performance indicators of the educational organization.

4.2. Certification of the head of an educational organization is carried out on the basis of a submission to the certification commission by his immediate supervisor.

4.3. The following managers are not subject to certification:

- those who have worked in the position for less than one year;

- pregnant women;

— women on maternity leave;

- those on parental leave until the child reaches the age of three;

- absent from work for more than four months due to illness.

Certification of managers listed in subparagraphs “c”, “d” and “e” is possible no earlier than one year after they start working.

4.4. The submission must contain the following information about the manager:

- Full Name;

- place of work;

— date of conclusion of the employment contract and its validity period (for a fixed-term employment contract);

— level of education and qualifications;

— information on advanced training (retraining);

— motivated, comprehensive and objective assessment of professional, business qualities, results of professional activities based on the professional standard (qualification characteristics) “Head of an educational organization”;

— the reason that served as the basis for the certification.

4.5. The head of the educational organization must be familiarized with the submission by the immediate supervisor against signature no later than a month before the day of certification. After reading the submission, the head of the educational organization has the right to submit to the certification commission his own information characterizing his work activity over the past three years, as well as a statement with appropriate justification in case of disagreement with the information contained in the submission of the immediate supervisor.

If the head of the educational organization refuses to familiarize himself with the submission, a corresponding act is drawn up, which is signed by the immediate supervisor and the persons in whose presence the act was drawn up.

4.6. The head of the educational organization must be personally present at the meeting of the certification commission during his certification.

If the manager is unable to attend a meeting of the certification commission for valid reasons (illness, business trip, etc.), appropriate changes are made to the certification schedule.

If a manager fails to attend a meeting of the certification commission without a valid reason, the commission has the right to conduct certification in his absence.

4.7. The certification commission considers information about the certified person contained in the submission, his statement with appropriate justification in case of disagreement with the submission, and also assesses his compliance with the requirements of the professional standard (qualification characteristics) “Head of an educational organization.”

Members of the certification commission, if necessary, have the right to ask the certified person questions related to the performance of his official duties.

The secretary of the certification commission keeps minutes of its meeting, which records its decisions and voting results. The protocol is signed by the chairman, deputy chairman, secretary and members of the certification commission present at the meeting, and is stored as part of a separate file in the municipal (regional) body that manages the field of education.

4.8. Based on the certification results, the certification commission makes one of the following decisions:

— corresponds to the position “Head of an educational organization”;

- does not correspond to the position “Head of an educational organization.”

4.9. The certified person becomes familiar with the certification results, documented in the protocol, against signature.

4.10. The certified person has the right to appeal the results of certification to the court in accordance with the legislation of the Russian Federation.

4.11. For everyone who has passed certification, an extract from the protocol is drawn up containing the following information: last name, first name, patronymic of the person being certified, his place of work and position, the date of the meeting of the certification commission, the results of voting when making a decision, which is signed by the secretary of the certification commission. An extract from the protocol and the presentation (application) are stored in the personal file of the person being certified.

Certification of heads of educational institutions in 2019 involves some activities aimed at assessing the qualifications of an employee, his skills, knowledge and experience. For heads of educational institutions subordinate to the Ministry of Education and Science, it is carried out at least once during the period of validity of the employment contract. As for the assessment of suitability for the position held, it must take place within a year after the manager takes office.

The rules for conducting certification, the list of persons exempt from passing it, and other details of this event are stipulated in several regulations. For example, in the Law on Education dated December 29, 2012 No. 273-FZ, Order of the Ministry of Education and Science of Russia dated March 16, 2015 No. 240 and others.

Procedure for certification

The assessment consists of two successive stages: studying the provided documents and an interview. For this purpose, the relevant department creates an attestation commission, prepares a list of candidates, as well as the necessary papers. Documents are then requested from candidates. The commission determines its work procedure independently.

Seven working days before the start, the candidate is notified of the verification by telephone or mail. The notice shall indicate the date, time and place of the knowledge test. If the person being certified does not appear at the specified time without a good reason or prior refusal, he will be subject to disciplinary liability, and the event will be postponed.

MIOO: certification of managers and candidates

On the official website of the Moscow Institute of Open Education (MIOO), you can familiarize yourself with the procedure for conducting a knowledge test, as well as submit an application to pass it. To do this, you need to fill out a form on a special page. It contains basic information, contact details of the subject and attaches scans of the required documents.

What is needed for certification

The candidate or current head of the institution must provide a set of documents specified in the Order. All of them must be in Russian. Among them:

  • report on activities in a leadership position - the results of the development program;
  • certificate of compliance of the manager with the requirements of Part 1 of Art. 351.1 Labor Code of the Russian Federation;
  • consent to conduct an assessment - includes contact information, a list of documents provided, etc.;
  • consent to review and study the provided documents;
  • the opinion of the collegial governing body of the educational institution based on the results of studying the submitted report.

Other documents that contain information useful to the commission may also be provided. In addition, candidates for the position of manager must provide a certificate of no criminal record. The list varies depending on the jurisdiction of the educational institution. The table below contains a list of documents required to pass certification in departmental educational institutions.

If any documents were not submitted in full or were not submitted, the examinee is excluded from the assessment.

Who is exempt from passing

According to the Order and Law dated December 29, 2012 No. 273-FZ, the following are exempt from undergoing inspection:

  • managers appointed to positions by the President or the Government of the Russian Federation;
  • have worked in their position for less than one year;
  • pregnant women;
  • women on maternity leave;
  • persons on parental leave until the child reaches the age of three.

As for the last two categories of workers, their knowledge is assessed no earlier than a year after leaving leave.

Depending on which department the institution is subordinate to, the frequency of inspections varies. For example, testing the knowledge of the management of educational institutions under the jurisdiction of the Federal Air Transport Agency, the Ministry of Justice, the FANO, and the Federal Customs Service takes place every five years.

Certification results

If the results of the inspection reveal that the head of the institution does not meet the existing requirements, he will be able to go through it again. Re-evaluation is carried out on the basis of the examinee’s application. In this case, the commission can authorize or refuse the inspection. In case of refusal, the manager is suspended from performing his duties until the certification is successfully completed.

If the commission decides that the head of the organization is not suitable for his position, he can be dismissed on the basis of clause 3 of part 1 of Art. 81 Labor Code of the Russian Federation.

Industrial safety certification of managers and specialists

Industrial safety certification of managers and specialists of educational institutions is not carried out, since only specialists working at industrial and construction sites, as well as hazardous industries, must undergo it. Employees of organizations subordinate to Rostechnadzor must also undergo such an assessment.
