Basic rules for placing an order

Today, the law says that an order to transfer an employee from one position to another can be issued in a free form. However, many enterprises and organizations, in the old fashioned way, prefer to use the previously approved and widespread T-5 form. This is understandable: the form contains all the necessary data, including information about the employer and subordinate, information about the former and new place of work, reasons for the transfer, etc.

The order can be filled out either by hand or on a computer, but it is printed out in a single copy and, after writing, is given first to the manager for signature, and then for review to the employee for whom it was drawn up. The procedure for filling out the order form in the T-5 form

The order form must be filled out with the following information:

  • name of the employer's company, OKPO;
  • number and date of issue of the order - the number is determined by the numbering of administrative documentation in accordance with the registration journal, which all companies are required to maintain; the number can be supplemented with letter designations for convenience;
  • date of transfer to another job - the day when the employee begins new duties;

  • basis - a document justifying the transfer, as a rule, an additional agreement is drawn up to the employment contract, which specifies changes in the place of work, indicates the number and date of this basis document, and the basis may also be another document, for example, a medical report, if the reason for moving to another work - the employee’s health status, application for transfer from an employee;
  • approval signature of the director of the company;
  • employee's introductory signature.

When you can’t and when you can refuse a transfer

There are situations in which the employer does not have the right to refuse to transfer an employee to another position: this is the employee’s pregnancy and the presence of young children, the presence of medical indications, etc. But, for example, a transfer due to staff reduction or to another location at the initiative of the organization is possible only with the personal written consent of the employee.

A variation of such an order is an order in the T-5a form, which is used in the case of the transfer of several employees within one organization at the same time (for example, when changing the staffing table).

An order in form T-5 is issued to transfer an employee to another job, either permanent or temporary. The main columns contained in the order concern the following information about the transfer:

  • description of the previous and new places of work (department/structural unit, position (specialty, profession), rank, class (category) of qualifications), tariff rate, salary;
  • reason for transfer (for example, employee application, change in staffing table);
  • basis for transfer (order of the head of the organization);
  • details of the employment contract or additional agreement defining the relationship between the employee and the employer as its parties.

In the case when we are dealing with a permanent change in position, it becomes necessary to sign an additional agreement to the employment contract in which these changes will be recorded.

Reason for transfer

The documentary basis for the transfer of an employee, reflected in the transfer order in form T-5, may be:

  • Permanent transfer to a new job within the organization at the request of the employee, expressed in the application, as well as with the consent of the manager;
  • Permanent transfer to another position on the basis of local documents issued and accepted by the organization (memorandum, order of the manager);
  • Temporary transfer to replace a temporarily absent employee (vacation, long-term illness). The end of such a transfer is the return to work of the main employee;
  • Temporary transfer to another position based on a medical report (for example, for a pregnant woman until the start of maternity leave). The deadline for such a transfer is indicated in the conclusion itself.

This basis serves to confirm the transfer, indicates the initiator of the transfer (employee or employer), as well as the informed consent of the other party to the labor relationship (the signature of the parties indicates voluntary consent and awareness).

We fill out the T-5 form and make an entry in the work book

The employee must be familiarized with the order to transfer T-5 against signature within three days. Article 66 of the Labor Code of the Russian Federation provides a rule that, on the basis of an order to transfer an employee to another job, an entry is made in the employee’s work book, if we are talking about a permanent transfer.

An entry in the work book about the transfer is made on the basis of an order (instruction) of the employer no later than a week and must exactly correspond to the text of the order (instruction) (clause 10 of the Rules for maintaining and storing work books, producing work book forms and providing them to employers, approved by the Resolution Government of the Russian Federation dated April 16, 2003 N 225 “On work books”).

How to fill out a transfer order correctly

Filling out the T-5 form begins with the details that will provide the document with the necessary legal force. These include:

Title of the document;
- date of preparation of the document, its serial number;
- name of the organization in which the document was drawn up;

The text of the order must begin with the words “transfer to another job.” Next, write the date from which the employee will be transferred. If the transfer is temporary, then the exact timing of the transfer is indicated. This situation may arise, for example, when replacing an employee during a period of parental leave to care for a child under three years of age. The first part of the T-5 form

The first part of the document indicates the full name of the organization, the OKPO code (in accordance with the registration papers), as well as its internal document flow number and the date of its preparation.

  • If the transfer is temporary, then the start date and end date of the work (if the latter is known) should be indicated.

The second part of the T-5 form

In the second part of the document, information about the employee’s previous place of work is first entered, namely the structural unit where he worked and his position (in accordance with the staffing table). In the next line you need to indicate the reason for the transfer.

The second table contains information about the new location:

  • department name,
  • job title,
  • as well as the size of the tariff rate and all possible allowances due to the employee.

Next, you need to provide a link to the documents that served as the basis for issuing the order: usually this is either a statement from the employee or a memo from his immediate superior. If the transfer is caused by some other factors (for example, an employee’s illness), then data from the supporting document (for example, a medical report) must be entered here.

Finally, the order should be given to the employee for review. Without his signature, the document will have no legal significance.

When you can’t and when you can refuse a transfer

A mandatory condition of the agreement between the employer and the employee is the existence of an employment contract, properly executed in accordance with the Labor Code (LC) of the Russian Federation. This document specifies the rights and obligations of the parties. During the period of validity of the employment contract, the employee may be transferred to another job (Articles 72, 73 of the Labor Code of the Russian Federation).

The reasons for the transfer may be different:

· another position or work on a permanent or temporary basis, as a result of which the terms of the employment contract significantly change;

· changing the functions of the unit in which the employee is located;

· change of location of the employer;

· transfer to work for another employer by transfer;

· medical report drawn up in accordance with the current legislation of the Russian Federation.

When is it necessary to issue an order to transfer an employee to another job?

The transfer is issued in the form of an order for an enterprise or organization. The unified form T-5 of such an order (instruction) was approved by Decree of the State Statistics Committee of the Russian Federation dated January 5, 2004 No. 1. According to the All-Russian Classifier of Management Documentation (OKUD), it corresponds to code 0301004. The order form is filled out by the responsible person of the personnel service or the accountant of the enterprise or organization and signed by it leader. After this, the employee reads the text and signs. The employee’s consent to the transfer is mandatory, excluding episodes of temporary transfer specified in Article 72.2 of the Labor Code of the Russian Federation. The unified form T-5 of the order must include a list of grounds for transfer. It is not allowed to transfer an employee to another position if there are medical contraindications.

The transfer of an employee should not be confused with his movement to another workplace (clause 3 of Article 72.1 of the Labor Code of the Russian Federation), which does not entail changes in the labor function and, accordingly, the terms of the employment contract.
