Are children's toys subject to return or exchange? Can children's toys be returned to the store? Toys that cannot be returned

01.04.2015

When buying children's toys, a situation very often arises that the child does not like the new acquisition, or two identical toys were bought and given as a gift for a holiday and the second one is simply not needed. Or, due to other reasons, it becomes necessary to return the toy to the seller. However, not all stores agree to accept the product back or exchange the toy for another with an additional payment or partial refund.

Accordingly, the buyer has a lot of questions: Are children's toys subject to return? Is it possible to challenge someone who refuses to accept the goods? How to properly process a return, and what documents are needed for this?

Moreover, these questions become relevant when an expensive toy is purchased, for example, a car or a radio-controlled helicopter, a children's motorcycle, a talking doll, etc. After all, now children's toys sometimes turn out to be quite an expensive pleasure. We will try to answer all of the above questions in our article, looking in more detail at the procedure for returning children's toys.

Under what circumstances can I return a toy to the store?

First of all, you can demand it if you were sold a defective children's toy. Wherein The buyer, at his discretion, may take the following actions:

  • demand that the toy be replaced with a new, high-quality one;
  • demand from the seller a reduction in value commensurate with the defect and a partial refund;
  • demand immediate elimination of existing deficiencies;
  • demand reimbursement of costs for repairs or replacement of low-quality spare parts;
  • completely refuse the purchase and demand a refund of the entire amount paid upon purchase.

Among other things, you can return the toy to the store, even if it is of absolutely high quality, if the following necessary conditions are met:

  • no more than 14 days have passed since the date of purchase;
  • there is a document available confirming that you actually purchased this product (cash or sales receipt);
  • The toy has not been used, the integrity and tightness of the packaging has been preserved.

What toys cannot be returned?

As for children's toys, then The list of goods that are not subject to exchange or return includes only two items, namely:

  • Stuffed Toys;
  • inflatable rubber children's toys.

And then, if they are in perfect order and the child simply did not need them or did not like them, then they cannot be returned. If such toys are faulty, turn out to have some defects, then you can safely demand their exchange or a full refund.

What should you pay attention to when purchasing children's toys?

To avoid buying, when buying children's toys, you must pay attention to the presence of the necessary information about the toy on the packaging or in another document. In accordance with the requirements of the Law "On" such information must necessarily include:

  • Name;
  • country of origin;
  • address of the manufacturer or importer, as well as their contact details;
  • quality trademark;
  • labeling;
  • the age for which this toy is intended;
  • the material from which it is made;
  • information about caring for it (can it be washed, at what temperature, etc.);
  • safety measures during operation;
  • if necessary, assembly instructions;
  • date of manufacture;
  • shelf life;
  • necessary storage conditions.

In addition, when purchasing from a seller, you can request a quality certificate; if it is missing or incorrectly issued, you can return the toy to the store, citing any doubts that have arisen. Also, what you should pay attention to is whether the seller has a demo sample of a particular toy. After testing and reviewing the product, you can request a new, fully packaged copy for yourself.

Documentation of the return of toys

It should be remembered that you can return the toy to the store only if certain formalities are met. In order to smoothly process a return, you must have a cashier's receipt confirming the purchase.

If you requested a refund on the same day on which the purchase was made, then you can issue a refund through the same cash register where the payment was made. To do this, you will be asked to write a statement addressed to the store administration indicating the reasons for the return, which is written in any form.

If you request a refund the next day or later, the refund is made from the general (main) cash register of the store, and to receive money you will need an identification document, preferably a passport.

If the purchase was paid for with a plastic bank card, then the only difference in this case will be that the refund is made not in cash, but by bank transfer back to the buyer’s card. At the same time, by contacting the store on the day of purchase, you can simply cancel the transaction at the terminal through which the purchase was made. If you want to return goods at the market, then prepare a sales receipt, which the seller must issue if his activities do not include the use of a cash register.

If the payment document was lost, then proof of purchase can be the toy itself, its packaging, as well as a cash register tape on which all information about cash transactions is duplicated and which must be stored in the store.

If you are unable to return the product yourself, you can write a letter to the consumer rights protection society, demand that it be carried out, or use the services of a lawyer. Of course, if the toy was not too expensive, then it will not be profitable. But if you have purchased an expensive model, then the services of a competent specialist will come in handy.

Competent lawyers will help you at all stages of processing a return, from free consultation to legal support at the stage of filing letters and complaints, and, if necessary, when contacting the judicial authorities. At the same time, if you win in court, all legal costs, incl. and fees paid will be recovered from the defendant.

Suppose that a child was given a new doll or car, but he did not like this thing at all. Or a purchase made on impulse turns out to be unsatisfactory upon closer inspection. Is it possible to return a toy to the store? What does the law say about this? The answer to these questions is contained in the article.

Letter of the law

Is it possible to return a toy to the store that the child did not like or was of poor quality? The law gives buyers the following rights.

  • An item for which there are no complaints about the quality can be returned to the store if 14 days have not yet expired from the date of purchase. The report is kept from the next day after the purchase of the goods. The item can be returned if the buyer is not satisfied with the packaging, shape, color, style, or dimensions. Therefore, it is recommended to formulate your complaints in advance.
  • It is possible to get your money back after this period if the buyer discovers elements of a defect (item of inadequate quality).
  • The purchase can be returned within the warranty period.

The law allows a buyer to file a complaint against a seller who refuses to respect any of the above rights.

Toys that cannot be returned

Unfortunately, there are products for children for which the buyer will not be able to get his money back if there are no complaints about their quality. Is it possible to return a soft toy to the store? The answer to this question is negative. For example, if the purchased plush bunny has no obvious defects, which include worn parts, holes, and so on, then the seller will refuse to exchange it or accept it back. The fact that the child did not like the toy is not a compelling argument.

It will not be possible to return not only soft, but also rubber inflatable products to the store.

Is it possible to return a quality toy to the store?

So, soft and rubber inflatable products cannot be returned if there are no complaints about their quality. Is it possible to return a toy made from other materials to the store? Yes, subject to the requirements listed below.

  • The item has retained its presentation. This means that the toy will have to be returned to the store in the same condition in which it was at the time of purchase. Tags, labels, packaging, etc. must be preserved. If something is damaged or lost, the return process will become more complicated.
  • No more than 14 days must pass from the date of purchase. Please note that the report is kept from the next day after the item was purchased.
  • The buyer has kept the receipt or receipt.

No receipt

Is it possible to return a toy to the store if the buyer does not have the receipt? A similar problem occurs quite often. According to the law, the absence of a sales receipt is not a significant basis for refusal. The client has the right to present any document proving the fact of purchasing the item in a specific store.

What if there is no such document? In practice, this often causes problems. In such a situation, you can resort to witness testimony. If a friend or relative was nearby at the time of purchase, he can take on the role of witness.

What to do if there was no one near the buyer? The client has the right to request verification of the cash register tape containing data on purchases made. Also, we must not forget that the store may have security cameras installed.

Poor quality toys

Is it possible to return a children's toy to the store if the buyer discovers a defect? The law gives consumers the following rights:

  • Demand that the toy be replaced with an analogue one, but of adequate quality.
  • Insist on reducing the cost of the purchased item taking into account the identified defect. This allows you to at least partially compensate for costs, which is especially important if the product is expensive.
  • Demand that the defect be eliminated at the seller’s expense.
  • Receive an amount sufficient to eliminate the identified deficiencies.
  • Return the toy to the store and insist on receiving its full price.

Where to begin

Above is the answer to the question of whether it is possible to return toys back to the store. Where should a buyer who plans to make a return start?

  • It is important to make sure that the product has no signs of use. The toy must fully retain its presentation.
  • You must find the receipt or sales receipt that was received upon purchase. If you do not have a document confirming the purchase of an item in a specific store, you should invite a witness with you, if you have one.

In the shop

What are the buyer's next steps? You must come to the store and declare your intention to return the purchased item. The client must provide the toy itself and all documents, and explain the reason for the return.

Next, the buyer will be asked to fill out an application. It can be drawn up in any form or according to a sample provided by the store employees. The application must include your passport details, so it is advisable to take your passport with you. You will also need to indicate the reason for the return.

If the toy is broken

Is it possible to return a broken toy to the store? It is permissible to return the product to the seller throughout the entire warranty period that is established for it. If the buyer does not keep the warranty card, as well as other documents confirming the purchase, this is not a reason for refusal.

What if the seller insists that the breakdown was not his fault and refuses to return the client’s money? In this case, an examination will be required. This procedure will allow you to identify manufacturing defects, for example, parts do not fit the grooves, components have begun to fall off. The examination can be carried out either by the seller or by the buyer himself.

We must not forget that the cause of premature failure of the toy may be careless handling. In this case, the buyer will not only not receive his funds back, but will also be forced to reimburse the cost of the examination.

About return periods

The above describes whether it is possible to return a purchased toy to the store. It is also interesting how quickly the buyer will receive his money back? If we are talking about returning a quality product, payment must be made immediately.

When trying to return a low-quality item, the buyer can receive his money only after an examination.

You also need to consider the method in which payment for the toy was made. If the buyer paid with a bank card, funds can only be returned to it.

What else do you need to know

Unfortunately, there are often cases when a store refuses to comply with the buyer’s requests for a refund. What can a client do in such a situation, who still expects to get his money back? There are several options to solve the problem:

  • Submit a claim.
  • Seek advice from a professional lawyer.
  • Conduct an examination yourself and then present its results to the seller.

We can conclude that in most cases the law is on the buyer’s side. Therefore, you should not give up trying to return money for a children’s toy, even if the child simply did not like it. Moreover, the client has the right to get money back if the product is of low quality.

Send a written complaint to the store indicating your requirements (exchange for a similar product of proper quality or return the money). Your copy must be marked as acceptance; if they refuse to accept, send your claim by registered mail with acknowledgment of receipt. Also indicate that if your demands are not met within 10 days, you will file a claim in court, and in addition you will ask, and the organization will pay a fine of 50% of the amount satisfied by the court (Article 13, paragraph 6).

The seller has the right to send the goods for examination to determine the culprit and the cause of the breakdown. You can be present during this examination or conduct your own independent examination at any service center. If, based on the results of the examination, it is determined that the buyer is the culprit of the breakdown, you will have to reimburse the seller for the expenses incurred by him.

Today we bring to your attention an article on the topic: “Are children's toys subject to return to the store?” We tried to fully cover the topic, and our specialist Sergey Shevtsov will share important comments based on his work experience.

  • Is it possible to return children's toys to the store if you don't like them?

    Children's toys are often bought at the child's whim, and it is not always possible to examine, much less evaluate, the product. The opposite situation may also occur, in which a carefully verified purchase turns out to be of poor quality. Any of these or other situations necessitates the return of the toy to the retail chain. Sellers, often justifying their actions by clauses of the consumer protection law, refuse to accept gaming products in the store. You need to figure out whether children's products really cannot be exchanged, and their return is impossible.

    Are children's toys subject to return or exchange - the law

    The Consumer Rights Protection Law stipulates that every person can return what they have purchased in two main cases:

    • The product has proper properties, but does not satisfy the buyer with its characteristics;
    • The purchased products were found to have manufacturing defects, or the breakdown occurred due to improper storage or transportation.

    The law has an exclusion list of goods that cannot be returned unless there are manufacturing defects. Toys are not included in this list. But according to the sales rules, there are still restrictions on returns.

    Products of proper quality can be returned provided that toys do not meet the specifications stated on the packaging, or the information that was received from the seller was not entirely reliable. When returning products of inadequate quality the main reason is the detected defect . In this case, the buyer will be required to prove the fact of making a purchase in this store by presenting a sales receipt, packaging with a bar code, warranty card or other evidence to the seller. Implicit or questionable failures are subject to expert evaluation. The expert makes a competent conclusion about how the breakdown was caused. Based on this assessment, the product may be accepted back or the store may refuse to return it.

    Is it possible to return children's toys to the store if you don't like them?

    It is not possible to return children's products due to children's lack of interest in this product. When returning, the main thing is the validity of the request. An exchange can be made even in the absence of compelling reasons, if you reach an amicable agreement with the seller. A friendly approach can help the consumer in exchanging a purchase. To do this, the item must be preserved in its marketable condition, that is, it could not have been used. A broken toy without packaging cannot be exchanged.

    According to the rules for accepting returns of children's goods, the following cannot be returned:

    • Goods classified as soft;
    • Rubber products that must be inflated to operate.

    These prohibitions are related to the personal hygiene of children and adults.

    How long can I return a toy to the store?

    You can return goods to Children's World within a period of 0 days to 2 years. According to the rules of the Russian Federation, the return of toys of proper properties to the store is possible from the date of purchase for 2 weeks. By law, this period is counted not from the date of acquisition, but from the next day after registration of the item.

    If the consumer intends to hand over low-quality products, then he must understand that the entire warranty period is at his disposal. The absence of a warranty period allows the consumer to count on a return period determined by law, measured in two years (details on the warranty period in the consumer rights law can be found here). Even the past warranty period makes it possible to return children's goods, for example, complex technical ones. It may happen that a manufacturing defect causes a breakdown after the warranty period has expired. Having proven this fact, the consumer has the right to return the product.

    Is it possible to return a children's toy to the store without a receipt?

    The law clearly states the rule regarding the presentation of a receipt when returning products. A cash receipt is one of the essential proofs of purchasing an item in a store. A copy of the receipt is always attached to the claim, and it also serves as justification for the amount to be returned. But the consumer protection law allows you to return children's items if the buyer is able to prove that the product was purchased in this store.

    To prove this you can use:

    • Raising cash register tapes stored in the store and duplicating customer receipts;
    • Verification of the product by barcode, if the outlet operates a system for registering children's products by code;
    • Presentation of evidence in the form of testimony.

    In fact, it is not so difficult to prove the fact of purchase; it is much more difficult to defend your right to return. The law allows you to return goods without a receipt, this is true. But sometimes sellers refuse to accept even manufacturing defects, and sometimes it’s impossible to return quality products.
